900 KAR 1:090. Health care reporting requirements

  •       Section 1. Reporting Requirements. The Secretary of the Cabinet for Human Resources shall report the activities undertaken to implement the provisions contained in 1994 Ky. Acts ch. 512.

          (1) The initial report shall be due on October 15, 1994 and subsequent reports due on the 15th day in the months of January, April and July.

          (2) The report shall describe activities related to:

          (a) Reducing unnecessary emergency room use by Medicaid recipients pursuant to 1994 Ky. Acts ch. 512;

          (b) Instituting copayments in the Medicaid Program pursuant to 1994 Ky. Acts ch. 512;

          (c) Reviewing and determining appropriate Medicaid reimbursement policies pursuant to 1994 Ky. Acts ch. 512;

          (d) Preventing, detecting and investigating fraud and abuse in the Medicaid Program pursuant to 1994 Ky. Acts ch. 512;

          (e) Reviewing innovative or experimental programs for the purpose of reducing costs for institutionalized populations pursuant to 1994 Ky. Acts ch. 512;

          (f) Developing new managed care programs for medical assistance recipients pursuant to 1994 Ky. Acts ch. 512;

          (g) Prohibiting or reducing sheltering of assets as a means of obtaining eligibility for the Medicaid Program pursuant to 1994 Ky. Acts ch. 512;

          (h) Increasing third party collections pursuant to 1994 Ky. Acts ch. 512;

          (i) Reviewing Medicaid reimbursement policies pursuant to 1994 Ky. Acts ch. 512;

          (j) Increasing access to health care services pursuant to 1994 Ky. Acts ch. 512; and

          (k) Developing enhanced technologies to effectively monitor use of Medicaid services pursuant to 1994 Ky. Acts ch. 512;

          (3) Copies of the report shall be forwarded to the Executive Director of the Legislative Research Commission, the Interim Joint Committee on Health and Welfare, the Speaker of the House and the President of the Senate. (21 Ky.R. 804; eff. 9-21-94.)

      NECESSITY, FUNCTION, AND CONFORMITY: 1994 Ky. Acts ch. 512 specifies that the Cabinet for Human Resources and the Department for Medicaid Services shall implement various provisions of the Health Care Reform Act. The Act requires the cabinet to report quarterly to the General Assembly on the progress in implementation. This administrative regulation sets forth the procedure for meeting the reporting requirement. These sections relate to changes and improvements to the Medicaid Program and to increasing accessibility to health care services.
