810 KAR 1:021. Backside Improvement Fund

  •       Section 1. Definition. "Backside facilities" means those facilities located at thoroughbred horse racing associations in Kentucky where horses are stabled and quartered and where stable employees work and live.

     

          Section 2. All monies disbursed by the Kentucky Horse Racing Authority pursuant to KRS 230.218 shall be used solely for improvements to backside facilities as defined in Section 1 of this administrative regulation.

     

          Section 3. (1) An application for monies under the auspices of the Kentucky Horse Racing Authority for backside improvement shall be submitted to the main office of the Kentucky Horse Racing Authority.

          (2) An application shall include the following:

          (a) A prioritized list of all proposed projects;

          (b) A full written and graphic description of each proposed project, with written justification of the need for each;

          (c) An itemized cost estimate of each proposed project; and

          (d) Any contract in existence relating to the proposed improvements.

          (3)(a) Except for the circumstances addressed in paragraph (b) of this subsection, an application shall be approved or denied at the first regularly scheduled Authority meeting that occurs after the application has been submitted.

          (b) If the application is submitted within seven (7) calendar days before a regularly scheduled Authority meeting, the approval or denial of the application shall be deferred until the next meeting.

          (4) Approval of the application shall be based on the likelihood of the project proposal to promote, enhance, and improve the conditions of the backside of eligible racing associations in Kentucky, including the living and working quarters of backside employees.

     

          Section 4. All disbursements of monies and other transactions between the Kentucky Horse Racing Authority and the horse racing association involved shall be according to the terms and conditions of the project proposal as approved by the Authority.
