804 KAR 9:030. Beer distributor license limit

      Section 1. The number of beer distributor's licenses issued by the Department of Alcoholic Beverage Control in the Commonwealth shall not exceed a number equal to one (1) for every thirty-six (36) retail beer licenses issued by said Department of Alcoholic Beverage Control.

 

      Section 2. This administrative regulation shall not prohibit the renewal of licenses. The present quota shall be reduced, in conformance with this administrative regulation, as licenses are revoked or surrendered.       NECESSITY, FUNCTION, AND CONFORMITY: The express provision of KRS 241.060(2) empowers this board to limit the number of licenses of all types issued in the State of Kentucky. This administrative regulation establishes a limit on beer distributor's licenses and establishes the manner in which the number is to be ascertained.
