804 KAR 8:060. Persons not eligible to be licensed

Section 1. No person, firm or corporation shall hold a transporter's license for distilled spirits and wine or for malt beverages if he owns any interest as a stockholder or otherwise in any other license issued by this cabinet, or does not qualify under KRS 243.110 or 243.210. NECESSITY, FUNCTION, AND CONFORMITY: This administrative regulation is specifically designated to prevent the holder of any other license issued by the Department of Alcoholic Beverage Control from holding a transporter's license for distilled spirits and wine or for malt beverages. The purpose of a transporter's license is to enable the transportation of alcoholic beverages for any licensee desiring such service. This administrative regulation prevents the holder of any other license from securing a transporter's license and then refusing to transport except for their own purpose.
