804 KAR 4:310. Caterer's license

  •       Section 1. License Issuance and Application Requirements. The distilled spirits administrator and the malt beverage administrator, jointly, may issue a license to a caterer for premises that contain a permitted and inspected commissary. A license may be issued only upon proper application and upon meeting the requirements set forth in KRS 243.020 to 243.670 for licenses to sell alcoholic beverages. Proof of a retail food establishment permit issued by the Cabinet for Human Resources shall accompany the license application.

     

          Section 2. Vehicle Identification. Signs shall be painted on or securely attached to all vehicles used by the licensee to transport alcoholic beverages by magnetic-type signs in a color (or colors) contrasting with the color of that portion of the vehicle upon which the sign is placed, one (1) on both the right and left sides; the side signs shall be in uniform letters, not less than three (3) inches high, in the following form:

          Section 3. Advertising. Advertising practices shall conform to 804 KAR 1:100.

     

          Section 4. Food Percentage Requirement. The receipts from the catering of food at any catered event shall be the percentage of the gross receipts from the catering of both food and alcoholic beverages pursuant to KRS 243.033. Otherwise, alcoholic beverages shall not be catered at that event.

     

          Section 5. Reporting of Functions. Caterer licensees shall keep records as set forth in KRS 244.150 and 804 KAR 4:100. (19 Ky.R. 1981; Am. 2260; eff. 5-10-93; 30 Ky.R. 1096; 1513; eff. 1-5-2004; 31 Ky.R. 621; eff. 11-26-04.)
