804 KAR 3:100. Retail sales to certain persons prohibited

  •       Section 1. No licensee of the Department of Alcoholic Beverage Control of the Commonwealth of Kentucky shall accept U.S.D.A. food coupons (or any other food coupon) in exchange for alcoholic beverages of any kind, whether it be distilled spirit, wine, beer, near beer, or any other beverage containing alcohol in any amount.       STATUTORY AUTHORITY: KRS 241.060

      NECESSITY, FUNCTION, AND CONFORMITY: By the terms of KRS 243.490(1), this board may revoke a license issued to a licensee for violation of an act of congress relating to alcoholic beverages. Since federal food stamp regulations prohibit the sale of alcoholic beverages in exchange for food coupons, this administrative regulation states specifically that any licensees accepting food stamps in return for alcoholic beverages are subject to having their licenses suspended or revoked.
