804 KAR 11:020. Container charge or deposit

Section 1. (1) Every brewer and distributor shipping beer into and selling beer within the Commonwealth of Kentucky shall collect a minimum container charge or deposit of sixty (60) cents per case of twenty-four (24) twelve (12) ounce returnable bottles or the equivalent thereof.
(2) Every brewer and distributor shipping beer into and selling beer within the Commonwealth of Kentucky shall collect a minimum container charge or deposit of sixty (60) cents per case of twelve (12) thirty-two (32) ounce returnable bottles or the equivalent thereof.
Section 2. No manufacturer of malt beverages shall use the cooperage, cases or cartons of any other manufacturer of malt beverages, nor shall any distributor of malt beverages use the cooperages, cases or cartons of any manufacturers of malt beverages other than those whose products are sold by it, except with the express consent of the Department of Alcoholic Beverage Control. NECESSITY, FUNCTION, AND CONFORMITY: This administrative regulation is necessary in order to prevent brewers or distributors from refusing to collect a deposit upon returnable bottles as an inducement to the sale of their product. The administrative regulation establishes a minimum container charge or deposit that must be collected by all brewers or distributors doing business in the Commonwealth of Kentucky.
