702 KAR 6:010. Local responsibilities

  •       Section 1. The operation of all school nutrition programs in the public, private, parochial and state schools shall be the responsibility of the local board of education or the governing body of the schools.

     

          Section 2. Each local board of education or the governing body of a school shall establish written requirements regarding the employment, dismissal, promotion, work assignments, emergency leave, sick leave, vacation leave, retirement, insurance, workmen's compensation and salary schedules providing at least minimum wage in accordance with minimum wage laws.

     

          Section 3. Each local governing body shall establish written requirements regarding purchasing food and equipment, cost of meals, storage and sanitation, and financial accounting and safeguarding of funds.       NECESSITY, FUNCTION, AND CONFORMITY: KRS 156.010(5) requires the Department of Education to develop and approve state plans required by federal law as a prerequisite to receiving federal funds for elementary and secondary education. 42 U.S.C. 1751 to 1769b and 42 U.S.C. 1771 to 1789 establish the requirements for the federal school lunch and child nutrition programs. This administrative regulation establishes the responsibilities of school districts and school governing bodies relating to school lunch and child nutrition programs.
