605 KAR 1:200. Manufacture and sale of motor homes

Section 1. Definitions. (1) "Motor home" means a new vehicular unit designed to provide temporary living quarters built into an integral part of or permanently attached to a motor vehicle chassis. The vehicle must contain permanently installed independent life-support systems, other than low-voltage, which meet the American National Standards Institute (ANSI) Standard A119.2, Standards for Recreational Vehicles, effective February 12, 1993 contained in a publication titled "ANSI A119.2, NFPA 501C, RECREATIONAL VEHICLES, 1993 EDITION" published by the National Fire Protection Association on January 22, 1993, or updated editions thereof, said publication being adopted by reference herein, and provide at least four (4) of the following facilities:
(a) Cooking with on-board power source;
(b) Gas or electric refrigerator;
(c) Toilet with exterior evacuation;
(d) Heating with on-board power source and/or air conditioning separate from the vehicle engine;
(e) A potable water supply system including a faucet, sink and a water tank with an exterior service connection;
(f) Separate 110-125 volt electric power supply. All documents incorporated by reference herein are on file for public inspection and copying at the office of the Motor Vehicle Commission, 114 West Clinton Street, Frankfort, Kentucky 40601, during normal business hours.
(2) "Permanently installed" means built into or attached as an integral part of a motor vehicle chassis and designed not to be removed, except for repair or replacement. A system which is readily removable or held in place by clamps or tie-downs is not permanently installed.
(3) "Motor home manufacturer" means a person other than the manufacturer of the chassis of a motor vehicle who, prior to the retail sale of the motor vehicle, performs modifications on the chassis that result in the finished product being classified as a motor home.
Section 2. The license fee for a calendar year or any part of a calendar year for a motor home manufacturer shall be $100.
Section 3. Motor homes shall be advertised, displayed or sold as new motor vehicles pursuant to a franchise or sales and service agreement with a licensed motor home manufacturer, and only under the name of the motor home manufacturer and not under the name of the motor home's chassis manufacturer. STATUTORY AUTHORITY: KRS 190.015, 190.020, 190.030(1), 190.058(9), 190.073
NECESSITY, FUNCTION, AND CONFORMITY: KRS 190.030 authorizes the Motor Vehicle Commission to provide by administrative regulation for other licensee activities and an appropriate fee. KRS 190.058 authorizes the Motor Vehicle Commission to establish the qualifications of manufacturers and dealers. KRS 190.073 authorizes the Motor Vehicle Commission to promulgate appropriate and reasonable administrative regulations for the purpose of carrying out the provisions of KRS Chapter 190. The function of this administrative regulation is to provide a means for motor home manufacturers to qualify for a license in order to enter into franchise agreements authorizing Kentucky dealers to sell new motor homes as new motor vehicles and to otherwise conduct necessary business functions in accordance with applicable state laws and administrative regulations.
