401 KAR 63:021. Existing sources emitting toxic air pollutants

Section 1. A source in existence on the effective date of this administrative regulation which was issued a permit pursuant to 401 KAR 50:035 with conditions based on this administrative regulation or 401 KAR 63:022 shall continue to comply with all conditions based on this administrative regulation or 401 KAR 63:022 unless it can demonstrate that a condition is no longer necessary to protect human health and the environment. NECESSITY, FUNCTION, AND CONFORMITY: KRS 224.10-100 requires the Natural Resources and Environmental Protection Cabinet to prescribe administrative regulations for the prevention, abatement, and control of air pollution. There is no federal mandate for this administrative regulation. This administrative regulation provides for the control of emissions of toxic air pollutants.
