401 KAR 44:030. Standards for used oil collection centers and aggregation points

  •       Section 1. Do It Yourselfer Used Oil Collection Centers. The subject matter shall be governed by 40 C.F.R. 279.30, effective July 1, 2005.

     

          Section 2. Used Oil Collection Centers. (1) Except as provided in subsection (2) of this section, the subject matter shall be governed by 40 C.F.R. 279.31, effective July 1, 2005.

          (2) Owners or operators of each used oil collection center shall register initially with the Recycling and Local Assistance Branch of the Division of Waste Management at 300 Sower Boulevard, Frankfort, Kentucky 40601 by submitting a completed "Used Oil Collection Center Registration and Annual Reporting Form", DEP-5034. Subsequent annual reports shall be submitted to the branch on the "Used Oil Collection Center Registration and Annual Reporting Form", DEP-5034, prior to January 31 annually.

     

          Section 3. Used Oil Aggregation Points Owned by the Generator. The subject matter shall be governed by 40 C.F.R. 279.32, effective July 1, 2005.

     

          Section 4. Incorporation by Reference. (1) "Used Oil Collection Center Registration and Annual Reporting Form", DEP-5034, April 2007, is incorporated by reference.

      STATUTORY AUTHORITY: KRS 224.10-100, 224.46-510, 224.46-530, 224.50-545

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 224.46-530 authorizes the Environmental and Public Protection Cabinet to promulgate administrative regulations. KRS 224.50-545 provides that used automotive and industrial oil be recycled or disposed of properly. This administrative regulation establishes standards for generators of used oil collection centers and aggregation points. This administrative regulation is equivalent to corresponding federal regulations except for a requirement to send a notification to the Recycling and Local Assistance Branch of the Division of Waste Management.
