Section 1. Appendix to Chapter 37. In determining the concentration of halogenated organic compounds (HOC's) in a hazardous waste for purposes of the 401 KAR 37:030, Section 4 land disposal prohibitions. The cabinet has defined the HOC's that shall be included in the calculation as any compounds having a carbon-halogen bond which are listed in this appendix (see 401 KAR 37:010, Section 2). This appendix to Chapter 37 consists of the following compounds:

STATUTORY AUTHORITY: KRS 224.10-100, 224.46-505, 224.46-520
NECESSITY, FUNCTION, AND CONFORMITY: KRS 224.46-520 requires that the cabinet may prohibit the land disposal of any hazardous wastes. KRS 224.46-520 requires that the cabinet allow land disposal of hazardous wastes when the disposal methods have been determined by the cabinet to be protection of human health and the environment for as long as the waste remains hazardous. This chapter establishes land disposal restrictions and treatment standards for hazardous wastes. This administrative regulation contains the appendix to this chapter concerning the California list of halogenated organic compounds regulated under landban.
