NECESSITY, FUNCTION, AND CONFORMITY: KRS 224.10-100(28) authorizes the Environmental and Public Protection Cabinet to promulgate administrative regulations. EO 2008-507 and 2008-531, effective June 16, 2008, abolish the Environmental and Public Protection Cabinet and establish the new Energy and Environment Cabinet. This administrative regulation defines essential terms that are used in 401 KAR Chapter 35. Some terms have been clarified to eliminate federal ambiguities and to conform to Kentucky statutory mandates. Definitions contained in KRS Chapter 224 have been referenced to the appropriate statutory citation. Some terms do not have a federal counterpart. These terms have been added to clarify requirements and provisions of KRS Chapter 224 and 401 KAR Chapter 35.
