30 KAR 1:050. Dishonored checks

Section 1. (1) Filing fees shall be paid when a document is filed in the Office of the Secretary of State.
(2) An entity which pays for its filing fees by check which is later dishonored shall have its filing voided and removed from the records of the Secretary of State. (17 Ky.R. 3582; Am. 18 Ky.R. 276; eff. 8-2-91; 20 Ky.R. 3208; eff. 8-4-94.)

NECESSITY, FUNCTION, AND CONFORMITY: The Secretary of State is required to collect a filing fee prior to filing all documents where a fee is specified. Occasionally the Office of the Secretary of State receives payment by a check which is later dishonored. This administrative regulation codifies existing practice and enforces the provisions of various Kentucky statutes that require the payment of fees prior to the filing of documents.
