302 KAR 77:010. Tobacco sales commission fees

Section 1. Any person who receives or undertakes to receive or take care of leaf tobacco for sale at public auction, whether with or without compensation, shall cause to be printed in conspicuous type on the front of the "weigh bill" and "pay sheet" given to each tobacco owner and producer, a schedule setting forth the rates of all commissions, fees, discounts, and deductions, and this requirement shall be enforced by the inspectors in the Division of Regulation and Inspection, Department of Agriculture. STATUTORY AUTHORITY: KRS 248.300
NECESSITY, FUNCTION, AND CONFORMITY: KRS 248.300(1) requires the department to supervise the sale of tobacco in warehouses. KRS 248.300(2) requires the commissioner to establish the duties of tobacco warehouse inspectors. This administrative regulation requires full disclosure of all commissions, fees, discounts, and deductions associated with the sale of leaf tobacco at public auction.
