2 KAR 2:040reg. Updated registration short forms for employers and legislative agents

      Section 1. (1) The ["]Legislative Agent’s Updated Registration Statement, Short Form["] may be filed by a legislative agent if, during a reporting period, the legislative agent[he] did not:

      (a) Expend sums for lobbying activities[during a reporting period]; and

      (b) Engage in a financial transaction governed by KRS 6.824.

      (2) The ["]Employer’s Updated Registration Statement, Short Form["] may be filed by an employer if, during a reporting period, the employer[he]:

      (a) Did not:

      1. Expend sums for lobbying activities[during a reporting period]; and

      2. Engage in a financial transaction governed by KRS 6.824; and

      (b) Paid only compensation to a legislative agent.

      (3) The ["]Legislative Agent’s Updated Registration Statement, Short Form["] shall include:

      (a) Name;

      (b) Address;

      (c) Telephone number;

      (d) Name of employer; and

      (e) The bills,[or] resolutions, or administrative regulations lobbied on during the reporting period.

      (4) The ["]Legislative Employer's Updated Registration Statement, Short Form["] shall include:

      (a) Name;

      (b) Address;

      (c) Telephone number;

      (d) Name and position of person completing the form;

      (e) Source of funds and financial resources;

      (f) Name(s) of individual legislative agent(s) and compensation accrued for each reporting period;

      (g) Bills,[or] resolutions, or administrative regulations lobbied on during the reporting period; and

      (h) Names of legislative agents terminated since last reporting period.

 

      Section 2.[(1)] The completed ["]Legislative Agent's Updated Registration Statement, Short Form["] and [shall be mailed to the Legislative Ethics Commission at 22 Mill Creek Park, Frankfort, Kentucky 40601.

      (2) The "]Legislative Employer's Updated Registration Statement, Short Form["] shall be filed electronically at www.klec.ky.gov unless the employer or legislative agent is unable to use electronic filing. If electronic filing is not possible, the forms shall be mailed or delivered to the Legislative Ethics Commission at 22 Mill Creek Park, Frankfort, Kentucky 40601. All forms shall be filed in accordance with the schedule set out in KRS 6.807(3).

 

      Section 3. Incorporation by Reference. (1) The following material is[forms are] incorporated by reference:

      PUBLIC HEARING AND PUBLIC COMMENT PERIOD: A public hearing on this administrative regulation shall be held on July 21, 2016 at 9:00 a.m. at the Legislative Ethics Commission, 22 Mill Creek Park, Frankfort, Kentucky 40601. Individuals interested in being heard at this hearing shall notify this agency in writing five workdays prior to the hearing of their intent to attend. REGULATORY IMPACT ANALYSIS AND TIERING STATEMENT

      (1) Provide a brief summary of:

      (a) What this administrative regulation does: This regulation incorporates by reference a short version of forms that are required to be filed by legislative agents and employers and provides information about completion and submission of the forms.

      (b) The necessity of this administrative regulation: It is necessary to comply with the requirements of KRS 6.666, 6.807, and 6.829 and to reflect an amendment to KRS 6.611(22).

      (c) How this administrative regulation conforms to the content of the authorizing statutes: This regulation sets out prescribed forms that are statutorily authorized and required for legislative agents and employers.

      (d) How this administrative regulation currently assists or will assist in the effective administration of the statutes: The regulation and material incorporated by reference sets out forms that are required to be filed by legislative agents and employers to register and provide information to KLEC as required by statute.

      (2) If this is an amendment to an existing administrative regulation, provide a brief summary of:

 (a) How the amendment will change this existing administrative regulation: The amendment updates the forms and instructions for completion.

      (b) The necessity of the amendment to this administrative regulation: To conform to the requirements of KRS 6.666, 6.807, and 6.829 and to reflect an amendment to KRS 6.611(22).

      (c) How the amendment conforms to the content of the authorizing statutes: It updates the prescribed forms for legislative agents and employers to register and report information required by statute.

      (d) How the amendment will assist in the effective administration of the statutes: The amendment provides additional guidance for completing the prescribed forms and updates the forms to make them clearer and easier to complete.

      (3) List the type and number of individuals, businesses, organizations, or state and local governments affected by this administrative regulation: This affects the KLEC, 565 legislative agents, and 684 employers of legislative agents.

      (4) Provide an analysis of how the entities identified in question (3) will be impacted by either the implementation of this administrative regulation, if new, or by the change, if it is an amendment, including:

      (a) List the actions that each of the regulated entities identified in question (3) will have to take to comply with this administrative regulation or amendment: Legislative agents and employers will have to complete the revised forms in accordance with the requirements in the regulation and statutes.

      (b) In complying with this administrative regulation or amendment, how much will it cost each of the entities identified in question (3): An exact cost of compliance is unknown, but it is not anticipated that the amendment to this administrative regulation will increase current costs.

      (c) As a result of compliance, what benefits will accrue to the entities identified in question (3): The LEC will receive the information required by statute in a uniform format and legislative agents and employers will benefit from instructions and forms that enable them to easily comply with statutory requirements.

      (a) Initially: No increase in fees or funding is anticipated.

      (b) On a continuing basis: No increase in fees or funding is anticipated.

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 6.666(5) and (6) require the commission to promulgate administrative regulations to implement KRS 6.601 to 6.849 and to prescribe required forms. KRS 6.807(3) requires each[an] employer or legislative agent registered with the Legislative Ethics Commission to file periodic updated registration forms. KRS 6.829(3) requires the commission to prescribe appropriate forms to file the information required by KRS 6.807. This administrative regulation establishes the short forms to be used by an employer or legislative agent if there is no expenditure or expense to be reported.
