201 KAR 19:050. Reexamination; reconsideration

  •       Section 1. Reexamination Applicants. An applicant who failed to successfully complete the examination under the provisions of KRS 323.090 and 201 KAR 19:040:

          (1) Shall be considered a new applicant for the examination; and

          (2) Shall submit a new application and processing fee.

     

          Section 2. Reconsideration of Applicants who were Denied Admission to Examination. (1) An applicant whose original application for admission to the examination was denied may request reconsideration by letter to the board with evidence that he has made up the deficiencies which caused the denial. A formal application or application fees shall not be required for this request if it is made within a period of three (3) years from the date denied.

          (2) After three (3) years a new application shall be submitted containing relative information on training and experience subsequent to the original application.       STATUTORY AUTHORITY: KRS 323.210(1)(b), (2)

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 323.210(1)(b), (2) requires the board to promulgate administrative regulations governing the contents and conduct of examinations, the method and time for filing applications, and the time within which an applicant shall be examined after his application has been filed. This administrative regulation prescribes conditions for reexamination and reconsideration of applications.
